Bakersfield California Workers' Compensation Lawyer

The advice you need to secure your Workers’ Compensation benefits

As of October 15, 2011, Joseph Pluta is one of only 11 attorneys in Bakersfield to be certified as a specialist in Workers’ Compensation law by The State Bar of California Board of Legal Specialization.  Certification requires a rigorous evaluation of an attorney's experience and credentials, in which an attorney must demonstrate that he or she is an active member of The State Bar of California, dedicates at least 25 percent of his or her practice to workers’ compensation claims, demonstrates technical and written proficiency with the subject matter, and earns recognition  by peers, judges, and members of the Workers’ Compensation Appeals Board as a qualified attorney in the field.

To date, Joseph Pluta has represented more than 5000 employees in various legal actions to secure workers' compensation benefits.  During 30 years in Workers' Compensation practice, he has represented clients in almost 1500 administrative hearings and trials before the California Department of Industrial Relations and the Workers’ Compensation Appeals Board.  In addition, he has represented other disabled clients before the Social Security Disability Administration and various judges in personal injury trials.

Free initial consultations.  Fees contingent on whether we win.

Our firm operates on a contingency fee basis and pays for all the upfront costs of filing a claim or handling an appeal—with the understanding that we are entitled to a percentage of the benefits or compensation we recover for you. In light of this "no fee if no recovery" policy, it stands to reason that our firm makes it a practice to only accept cases our attorney believes he can win.  Our goal is not to waste your time or ours, but to give you a fair assessment of your ability to successfully obtain benefits or compensation. If you do not win benefits, we are entitled to nothing — not even reimbursement for our personal expenses.

If your initial application for workers’ compensation benefits has been denied, you have nothing to lose by talking to our attorney about advocating for you through the administrative appeal and possibly at the hearing or trial, since the initial consultation is free and confidential.
